Last updated: November 2026. Checked on November 2, 2026 against the USCIS H-1B and G-1055 pages (fee schedule edition 10/26/26), the September 2025 and September 2026 H-1B proclamations, 8 CFR 214.2 and 8 CFR 204.5 (eCFR current to October 29, 2026), the USCIS Policy Manual (current as of October 27, 2026) and the November 2026 Visa Bulletin.
EB2 NIW vs H1B compares two different kinds of status. The H-1B is a temporary work classification. An employer files it after getting a certified Labor Condition Application, cap-subject cases must first be selected in USCIS registration, and total stay is generally limited to six years. The EB-2 national interest waiver (NIW) is an immigrant petition. You can file Form I-140 yourself, the job offer and labor certification are waived, and approval is a step toward permanent residence once a visa number is available. The two can overlap: H-1B rules allow you to seek a green card, and an approved or long-pending I-140 can support H-1B time beyond six years.
Below, all from official sources: a side-by-side table, a dated status box for the $100,000 H-1B payment, other 2026 H-1B rule changes, the H-1B extension rules, fees, and November 2026 EB-2 Visa Bulletin dates. We don’t rank the two. They do different jobs.
Key takeaways
- The H-1B is employer-driven: the worker comes to perform services “for… an employer, if petitioned for by that employer” (8 CFR 214.2(h)(1)(i)). For the NIW, USCIS says you “may self-petition (you do not need an employer to sponsor you).”
- As of November 2, 2026, USCIS says DHS “will comply with” a June 8, 2026 court order that vacated its guidance on the $100,000 H-1B payment. DHS also says it “still plans to collect the payment” if the order is lifted. A September 18, 2026 proclamation extended the underlying restriction to September 21, 2027.
- The H-1B cap is 65,000 a year plus 20,000 for U.S. master’s degree holders. Selection is now weighted by wage level. The NIW has no lottery, but EB-2 has annual and per-country limits. In November 2026 the EB-2 Final Action Date is April 1, 2025 for Rest of World and November 1, 2013 for India.
- An approved EB-2 petition, including a self-petitioned NIW, can support H-1B extensions in up to 3-year increments when the per-country limit is the only barrier (8 CFR 214.2(h)(13)(iii)(E)).
EB2 NIW vs H1B: side-by-side comparison
H-1B rules come from the USCIS H-1B page and 8 CFR 214.2(h). NIW rules come from the USCIS EB-2 page and 8 CFR 204.5(k).
| H-1B | EB-2 NIW | |
|---|---|---|
| Kind of status | Temporary (nonimmigrant) work in a specialty occupation | Immigrant petition (Form I-140) toward permanent residence |
| Who files | The employer or agent: a certified LCA from the Department of Labor, then Form I-129 | You may self-petition. An employer may also file. |
| Job offer | Required. The petition is for a specific position. | Waived, “and thus” the labor certification (204.5(k)(4)(ii)) |
| Core eligibility | A specialty occupation that requires “a bachelor’s or higher degree in a directly related specific specialty” | An advanced degree (or a bachelor’s plus five years of progressive experience) or exceptional ability, plus the three Dhanasar prongs |
| Numerical limits | 65,000 regular cap plus 20,000 master’s exemption each fiscal year; weighted selection for cap-subject cases; petitions from U.S. institutions of higher education are cap exempt | No lottery. EB-2 receives 28.6% of the worldwide employment-based level, subject to per-country limits, and the wait shows in the Visa Bulletin. |
| Length of stay | Admission for up to 3 years at a time, generally 6 years in total, with exceptions | Permanent once the green card is granted |
| Seeking a green card | Filing a preference petition “shall not be a basis for denying” an H-1B petition or extension (214.2(h)(16)(i)) | It is the green card petition |
| Family | Spouse and unmarried children under 21 in H-4. Some H-4 spouses can apply for a work permit. | If the I-140 is approved, your spouse and unmarried children under 21 may be eligible for E-21 and E-22 status |
| Premium processing | $2,965; action within 15 business days | $2,965; action within 45 business days |
The $100,000 H-1B payment: status as of November 2026
This is the part of the comparison most likely to change. Each line below is what the official source says, with its date.
| Date | What the official source says | Source |
|---|---|---|
| Sept. 19, 2025 | The proclamation restricts H-1B entry “except for those aliens whose petitions are accompanied or supplemented by a payment of $100,000.” It took effect at 12:01 a.m. EDT on Sept. 21, 2025, and was set to expire after 12 months unless extended. | whitehouse.gov (2025) |
| Sept. 21, 2025 | USCIS: new H-1B petitions filed at or after the effective time must include the payment. Petitions “filed without evidence of payment or the grant of an exception will be denied.” | USCIS alert |
| June 8, 2026 | The U.S. District Court for the District of Massachusetts “vacated agency guidance implementing the $100,000 payment requirement” (State of California v. Mullin, 1:25-cv-13829). | USCIS G-1055 page |
| July 24, 2026 | “The First Circuit denied the government’s motion” for a stay pending appeal. | USCIS G-1055 page |
| Sept. 18, 2026 | A new proclamation (No. 11069) extends the 2025 restriction “for an additional 12 months, until 12:00 a.m. eastern daylight time on September 21, 2027,” on the same $100,000 terms. It does not mention the litigation. | whitehouse.gov (2026); 91 FR 60497 |
| Oct. 28, 2026 | The updated G-1055 page still says DHS “will comply with the court’s order while DHS considers next steps” and that “if this order is later lifted, DHS still plans to collect the payment.” | USCIS G-1055 page |
USCIS says the payment covers petitions for beneficiaries outside the United States without a valid H-1B visa, and petitions requesting consular notification, port-of-entry notification or pre-flight inspection. It does not apply to previously issued and currently valid H-1B visas, to petitions filed before the effective time, or to an amendment, change of status or extension that USCIS grants for someone in the United States. Where the payment applies, it is made on pay.gov before filing.
What we could not confirm: none of the USCIS pages we checked on November 2, 2026 explains how the September 2026 extension interacts with the court order. We found no First Circuit merits decision on an official site. The litigation is ongoing, so check the USCIS H-1B page for the current status, and ask a licensed immigration attorney about any specific petition.
Other 2026 H-1B rule changes
- Weighted selection (final). The final rule (90 FR 60864) took effect February 27, 2026 and first applied to FY 2027 registration. That registration ran March 4 to 19, 2026, at $215 per registration (USCIS). Per the H-1B cap season page, wage level IV registrations enter the pool 4 times, level III 3 times, level II twice and level I once. USCIS said on July 17, 2026 that it had reached the FY 2027 cap.
- Lottery scale. For FY 2026, USCIS reported 343,981 eligible registrations and 120,141 selected registrations (registration data). The page did not show FY 2027 counts when we checked.
- 9-11 fee on extensions (final). A rule published August 10, 2026 applies the statutory fee to H-1B and L-1 extension petitions as well. It covers employers with 50 or more U.S. employees, more than half of them in H-1B or L status, for petitions filed on or after September 9, 2026. The G-1055 lists this fee as $4,000.
- $103,265 fee (proposed only). DHS has proposed (91 FR 54817, August 25, 2026) a $103,265 fee for all cap-subject H-1B petitions, including those under the master’s exemption. Comments closed September 24, 2026. We found no final rule as of November 2, 2026.
- Prevailing wages (proposed only). A Department of Labor proposal (91 FR 15454, March 27, 2026) would change how wage levels are computed for H-1B Labor Condition Applications and PERM. It was not final when we checked. An NIW waives the labor certification, so PERM wage rules are not part of an NIW I-140.
How an approved NIW I-140 can matter for H-1B extensions
Under 8 CFR 214.2(h)(13)(iii)(A), an H-1B worker who has spent six years in H or L status generally “may not seek extension, change status, or be readmitted” in H or L status without first spending a year abroad. Two exceptions tie that limit to the green card process:
| Rule | What it says | Increment |
|---|---|---|
| 8 CFR 214.2(h)(13)(iii)(D), pending case | H-1B time beyond six years if at least 365 days have passed since a labor certification or an immigrant visa petition was filed. “The H-1B petitioner need not be the employer” that filed it. You lose eligibility if you do not file for adjustment or an immigrant visa within 1 year of a visa becoming available, unless USCIS excuses it. | Up to 1 year |
| 8 CFR 214.2(h)(13)(iii)(E), approved petition | The beneficiary of an approved EB-1, EB-2 or EB-3 petition who is “eligible to be granted that immigrant status but for application of the per country limitation.” The petitioner must show visa unavailability on the H-1B filing date. “The H-1B petitioner need not be the employer that filed the immigrant visa petition.” | Up to 3 years |
Because the H-1B petitioner does not have to be the employer that filed the immigrant petition, a self-petitioned NIW can count. Each extension still needs a new H-1B petition from an H-1B employer, so an NIW does not replace the H-1B. Separately, an H-4 spouse may apply for a work permit when the H-1B worker “is the principal beneficiary of an approved Form I-140” (USCIS H-4 EAD page). Indian-born applicants face the longest EB-2 wait, covered in Can Indians Apply for EB-2 NIW? Whether an exception fits your dates and status is a question for a licensed immigration attorney.

What USCIS evaluates in an NIW, and the EB-2 queue
The H-1B asks whether a job is a specialty occupation and whether your registration was selected. The NIW asks about you and your plan. Under Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016) and the Policy Manual, Volume 6, Part F, Chapter 5, you first qualify for EB-2 through an advanced degree or exceptional ability. Then you show that your proposed endeavor “has both substantial merit and national importance,” that you are “well positioned to advance” it, and that “on balance” waiving the job offer would benefit the United States. “USCIS considers every petition on a case-by-case basis.” For an overview, read What is EB-2 NIW?
The NIW has no lottery, but it does have a queue. EB-2 visa numbers are limited each year and by country, so your priority date and country of birth set the wait (November 2026 Visa Bulletin):
| EB-2, November 2026 | Rest of World | China | India | Mexico | Philippines |
|---|---|---|---|---|---|
| Final Action Date | 01APR25 | 01OCT21 | 01NOV13 | 01APR25 | 01APR25 |
| Date for Filing | 15MAR26 | 01JAN23 | 15JAN15 | 15MAR26 | 15MAR26 |
For November 2026, USCIS says employment-based adjustment applicants “must use the Dates for Filing chart” (USCIS filing charts). An approved I-140 is not a green card or a work permit. Once your priority date is current on the chart USCIS designates, you can file Form I-485 in the United States and file Forms I-765 and I-131 with it, each with its own fee.
EB2 NIW vs H1B costs: who pays what
Amounts come from the G-1055 fee schedule, edition 10/26/26. H-1B fees are petitioner (employer) fees.
| Item | H-1B (Form I-129) | EB-2 NIW (Form I-140) |
|---|---|---|
| Registration | $215 per registration (cap-subject) | None |
| Base filing fee | $780 paper / $730 online; $460 for small employers and nonprofits | $715 paper / $665 online |
| Asylum Program Fee | $600 regular / $300 small employer / $0 nonprofit | $300 for self-petitioners |
| Other required fees | Fraud Prevention and Detection $500 (initial petition or new employer); ACWIA $1,500 or $750; $4,000 Pub. L. 114-113 fee for covered employers | None listed |
| $100,000 payment | Listed as “$100,000, unless an exception has been granted,” paid on pay.gov; subject to the court order above | Not applicable |
| Premium processing | $2,965 (15 business days) | $2,965 (45 business days) |
Premium processing timeframes come from the USCIS premium processing page, which promises “adjudicative action,” not approval. An RFE counts as action. For the full NIW budget, including later green card fees, see How Much Does EB2 NIW Cost?

Frequently Asked Questions
Is the $100,000 H-1B fee still in effect?
As of November 2, 2026, USCIS says DHS is complying with the June 8, 2026 court order that vacated its implementing guidance, and plans to collect the payment if the order is lifted. A September 18, 2026 proclamation extended the restriction to September 21, 2027. The litigation is ongoing, so check the USCIS H-1B page.
Can I file an EB-2 NIW while in H-1B status?
The rules allow it. Under 8 CFR 214.2(h)(16)(i), filing a preference petition “shall not be a basis for denying” an H-1B petition or extension. How a filing affects your own status is a question for a licensed immigration attorney.
Does an NIW avoid the H-1B lottery?
There is no NIW registration lottery. EB-2 has annual and per-country limits, though, so the wait depends on your priority date and country of birth in the Visa Bulletin.
Does an approved NIW I-140 let me work?
Not by itself. Work authorization can be requested on Form I-765 with a pending I-485. For H-1B holders, an approved I-140 can support extensions past six years under 214.2(h)(13)(iii)(E).
Is an NIW faster than an H-1B?
They are different steps, so there is no like-for-like answer. Premium processing means action within 15 business days for an H-1B petition and 45 for an NIW I-140. After NIW approval, the Visa Bulletin wait applies.
