Last updated: November 2026. Checked against the USCIS online-filing pages, the Form I-140 and I-485 pages, the G-1055 fee schedule (10/26/26 edition) and the November 2026 Visa Bulletin.
Yes, you can file EB2 NIW online. As of November 2026, USCIS accepts Form I-140 through a USCIS online account, but only by PDF upload: you complete the official PDF, upload it with your evidence, sign, and pay through Pay.gov. Since July 24, 2026, self-petitioners without a lawyer can also upload Form I-485 in the same online filing. Filing the I-140 online costs $50 less than mailing it, and online filing is not mandatory. One limit trips up many new filers. Adding the I-485 still depends on the Visa Bulletin, and in November 2026 a brand-new NIW petition does not qualify.
This guide covers what USCIS allows, the upload steps, how online and paper filing differ, premium processing, the October 2026 paper-filing changes and the new e-filing rule. It deals with filing mechanics only. For building the petition itself, see our EB2 NIW Application Process guide.
Key takeaways
- Form I-140 can be filed online only by uploading a completed PDF. USCIS lists it under the PDF-upload option, not the guided online form.
- Since July 24, 2026, self-petitioners without a representative can file Forms I-140 and I-485 together online.
- Online fees (G-1055, edition 10/26/26): I-140 $665 instead of $715 on paper, plus the $300 Asylum Program Fee for self-petitioners; I-485 $1,390 instead of $1,440.
- Each evidence file must be 12MB or smaller and must not be encrypted or password-protected.
- Sign with an original wet-ink signature on the PDF or with the digital signature inside your USCIS account. A typed name on the PDF’s signature line or a commercial e-signature tool is not accepted.
- Online filing is optional for now. A rule in effect since August 11, 2026 lets USCIS make a form online-only after 60 days’ notice. When we checked on November 2, 2026, there was no such notice for Form I-140 or Form I-485.
Can you file EB2 NIW online? What USCIS allows as of November 2026
USCIS has two ways to file through an online account. You can fill out a form in a guided workflow, or you can upload a completed PDF. On its Forms Available to File Online page (last updated October 7, 2026), Form I-140 is listed only under “Upload Completed PDF Online.” The Form I-140 page confirms there are two filing options: “By mail (paper); or Online.”
For NIW self-petitioners, the July 24, 2026 change matters most. USCIS’s page on additional PDF filing options for Form I-485 says: “Individuals who are filing a Form I-140 as a self-petitioner without a representative can file Form I-140 concurrently with Form I-485 online using PDF upload.” The forms you can upload with an online I-485 are G-28, I-130, I-131, I-140, I-485 Supplement A, I-485 Supplement J, I-693, I-765 and I-864. Form G-28 is needed only if you have an attorney or accredited representative.
If an employer files your petition and you have no representative, the rule is different: the employer files first from its own account, and you file the I-485 only after the petition is accepted.

How to file EB2 NIW online, step by step
These steps follow USCIS’s “How to File by PDF Upload” instructions on the Tips for Filing Forms Online page.
- Download the current editions. Get Form I-140 (edition 06/07/24) from the I-140 page. If you are eligible to add it, get Form I-485 too. Only the 09/18/26 edition is accepted. USCIS says its forms are optimized for Adobe Acrobat Reader 10.0 or higher and that other PDF software may lose data. Complete, sign and date the PDF as the instructions say.
- Create your own USCIS online account. The account guide says: “Do not create a shared account with anyone.” Every sign-in needs a one-time code sent by email, text or an authenticator app. The name, date of birth and A-number (if you have one) on your PDF must match your account exactly.
- Start the filing. Select “File a Form Online,” choose Form I-140, then “Upload a Filled-Out PDF Form,” and read each prompt carefully.
- Upload the form PDF, then your evidence. USCIS says each file “must not be larger than 12MB.” Files should generally be PDF, JPG or JPEG, and must not be encrypted or password-protected. For each foreign-language document, upload the original, a certified English translation and the translator’s certificate.
- Include the NIW-specific forms. The USCIS EB-2 page says NIW petitions must include a completed Form ETA-9089 Appendix A and a signed Form ETA-9089 Final Determination. The same page suggests organizing your evidence around each eligibility issue, in the order USCIS decides them.
- Sign. If you file for yourself, the PDF must carry an original wet-ink signature when you upload it. If it does not, you sign digitally in your account by typing your full legal name. USCIS calls that system signature “the only type of electronic signature that complies with USCIS regulations and policies.” After you submit, you cannot change anything.
- Pay on Pay.gov. You get a confirmation that the PDF was submitted. It does not include a receipt number.
- Watch your case card. USCIS says it “might take up to 30 days” to accept the form. Once the filing is accepted, the receipt number appears on the case card and a receipt notice is mailed to you. If USCIS rejects the filing, it sends a notice explaining why, and you can resubmit.

Adding Form I-485 to your online filing
If you add the I-485, the medical exam has to go in with it. For online filing, the Form I-485 page says you “must open the sealed envelope from the civil surgeon and upload the completed Form I-693.” Keep the original form and the envelope until USCIS makes a final decision. USCIS may ask to see them at an interview. You can also upload Form I-765 (work permit) and Form I-131 (advance parole) in the same filing. With a pending I-485, the I-765 fee is $260, and I-131 advance parole costs $580 online or $630 on paper.
Why a new NIW filer cannot add the I-485 in November 2026
Filing online does not change who may file an I-485. Under 8 CFR 245.1(g)(1), a visa must be immediately available on the day you file. That means your priority date must be earlier than the date shown in the Visa Bulletin. For November 2026, the USCIS filing-charts page says employment-based applicants must use the Dates for Filing chart. In the November 2026 Visa Bulletin, the EB-2 dates on that chart are 15MAR26 for Rest of World, Mexico and the Philippines, 01JAN23 for China and 15JAN15 for India.
According to the USCIS Policy Manual, an NIW petition’s priority date is the date it was properly filed with USCIS. A petition filed in November 2026 therefore gets a November 2026 priority date, which is later than every EB-2 date this month. In practice, you file the I-140 on its own now. Later, once your date is current under the chart USCIS designates, you can file a standalone employment-based I-485 online. Our EB2 National Interest Waiver Priority Date guide explains how to read the bulletin each month.
Premium processing and online filing: what USCIS says
As of November 2026, two USCIS pages say different things. The Form I-140 page (updated July 24, 2026) states: “If you are submitting Form I-140 together with Form I-907 to request premium processing, you must file by mail.” The Forms Available to File Online page (updated October 7, 2026) says Form I-907 can be filed online together with “Form I-140 if being filed by a self-petitioner, petitioner, or attorney or accredited representative.”
Both pages agree on one route. If your I-140 is already pending and its receipt number begins with IOE, you can file a standalone Form I-907 online by PDF upload, or by mail. The premium processing fee for an NIW I-140 is $2,965 either way. Premium processing applies to the I-140 only; the G-1055 does not list Form I-485 among the forms eligible for it. Read both pages again on the day you file, because one of them will likely be updated.
If you file on paper instead (as of November 2026)
- The I-485 address changed. USCIS changed the Form I-485 filing location on October 7, 2026. It will accept packages sent to a prior address only if they are postmarked on or before November 9, 2026. A combined I-140 and I-485 package goes to the address shown on the I-485 filing-addresses page, which lists the USCIS Dallas Lockbox for concurrent filings. If you add Form I-907, use the address in the I-140 filing addresses.
- Other addresses moved too. Forms I-765, I-131 and a standalone I-907 sent to upgrade a pending I-140 also have new mail locations from October 7, 2026, with the same November 9 grace period.
- No checks. USCIS no longer accepts personal or business checks, money orders or cashier’s checks for paper filings unless you qualify for an exemption on Form G-1651. Pay by card with Form G-1450 or from a U.S. bank account with Form G-1650. USCIS recommends a separate payment for each form, because with one combined payment a single defective form can get the whole package rejected.
- Keep the two packages separate. When filing the I-140 and I-485 together, the I-140 page says “do not combine your supporting documents.” Assemble each form with its payment form, the optional G-1145, the form itself and then its evidence.
- Medical exam. On paper, Form I-693 goes in the civil surgeon’s original sealed envelope.
Is online filing mandatory for EB-2 NIW?
Not as of November 2, 2026. The DHS interim final rule Mandatory Electronic Filing (e-Filing) took effect on August 11, 2026 (91 FR 51924). It added a rule to 8 CFR 103.2(a)(1): a form must be filed electronically only when all three of these are true:
- the form has been available for e-filing for more than 180 days;
- USCIS has decided to require e-filing for it; and
- USCIS has posted at least 60 days’ notice on uscis.gov giving the date paper filings stop.
In its announcement, USCIS says people who cannot file electronically may request a waiver, which it grants at its discretion for undue hardship. When we checked on November 2, 2026, we found no USCIS notice requiring Form I-140 or Form I-485 to be e-filed. Check the USCIS newsroom and the online-filing page before you mail a package.
Common slips when you file EB2 NIW online
- Uploading an old edition. For anything submitted on or after September 18, 2026, USCIS rejects every I-485 edition except 09/18/26.
- Filling the PDF in a browser or third-party app that drops data, instead of Adobe Acrobat Reader.
- A typed name on the PDF’s signature line, a pasted image of a signature, or commercial e-signature software. The I-140 page lists all three as unacceptable.
- Files over 12MB, password-protected files or unreadable scans.
- Throwing away the original I-693 and its envelope after uploading the scan.

Frequently Asked Questions
Can I file the EB-2 NIW I-140 online without a lawyer?
Yes. USCIS lists Form I-140 as a PDF-upload form, and self-petitioners file from their own USCIS account. Since July 24, 2026, you can add Form I-485 to the same filing if a visa is immediately available to you.
Is it cheaper to file EB2 NIW online?
Slightly. Under the 10/26/26 fee schedule, the I-140 costs $665 online versus $715 on paper, and the I-485 costs $1,390 versus $1,440. The $300 Asylum Program Fee, the $260 work-permit fee and the $2,965 premium processing fee are the same either way.
How do I sign a petition I upload online?
Either sign the printed form by hand in ink and upload the scan, or let the system prompt you to sign digitally in your account with your full legal name. If an attorney files for you, you must sign the PDF in wet ink, because only self-filers can use the digital signature.
When do I get a receipt number after filing online?
Not at submission. USCIS says acceptance can take up to 30 days. Once your filing is accepted, the receipt number appears on your case card and a receipt notice arrives by mail.
Will filing online get me a faster decision?
USCIS says e-filing in general reduces errors and incomplete submissions, but it does not promise a faster decision on any individual case, and filing online does not change the evidence standard. For current timing, use the official USCIS processing times tool, and see EB-2 NIW Processing Time.
