Can Indians apply for EB-2 NIW? Yes, Indians can apply for EB2 NIW. Nationality is not part of the test, and an Indian engineer, researcher or doctor files the same Form I-140 and meets the same Dhanasar standard as anyone else. The hard part of EB2 NIW India cases is the wait after approval: people born in India are charged to India’s own Visa Bulletin column. In November 2026 its EB-2 Final Action Date is 01NOV13 and its Date for Filing is 15JAN15. This guide explains what those dates mean, how they moved over the past year, and why many Indian professionals still file. One reason: an approved I-140 can extend H-1B status past six years, allow H-4 spouses to work, and lock in a priority date.
Key takeaways
- Eligibility does not depend on nationality. The EB-2 threshold and the three Dhanasar prongs are the same for Indian and non-Indian petitioners.
- The queue does depend on country of birth. India-born applicants wait in the India column, where the November 2026 EB-2 Final Action Date is 01NOV13.
- November 2026 is a “Dates for Filing” month at USCIS. Indians in the U.S. with an EB-2 priority date earlier than 15JAN15 may file Form I-485 this month, if otherwise eligible.
- An approved I-140 has value long before the green card: H-1B extensions in up to 3-year increments, H-4 EAD eligibility for a spouse, and a priority date that carries over to a later EB-1 petition.
- Child age protection uses the Final Action Dates chart, not the Dates for Filing chart, so families with teenagers should plan around the earlier date.
Can Indians apply for EB2 NIW? Who qualifies
Under the USCIS Policy Manual, you first qualify for EB-2 with an advanced degree (or a bachelor’s plus five years of progressive post-degree experience) or with exceptional ability. Then you show that a national interest waiver is warranted under Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016). That means showing your proposed endeavor has substantial merit and national importance, that you are well positioned to advance it, and that on balance waiving the job offer and labor certification benefits the United States. An Indian B.Tech, M.Tech, MS or PhD is assessed like any other foreign degree.
India is not named in Presidential Proclamation 10998. It was also not on the State Department’s January 2026 list of 75 countries whose immigrant visas were paused, a pause the Department says has not been in effect since August 21, 2026. Both checks are as of October 21, 2026; see the proclamation text and the State Department notice. For Indians, the obstacle is the numbers, not a travel measure.
EB2 NIW India in the November 2026 Visa Bulletin
A visa can be issued only when your priority date is earlier than the Final Action Date for your category and country. The Date for Filing is an earlier step: it controls when NVC invites document submission and, in months USCIS designates it, when you may file Form I-485. Here are the India columns from the November 2026 Visa Bulletin, with the Rest of World EB-2 column for comparison.
| Category (November 2026) | Final Action Date | Date for Filing |
|---|---|---|
| EB-1, India | 01FEB23 | 01JUL24 |
| EB-2 (including NIW), India | 01NOV13 | 15JAN15 |
| EB-3, India | 22JAN14 | 15JAN15 |
| EB-2, all countries not listed (Rest of World) | 01APR25 | 15MAR26 |
For November 2026, USCIS says employment-based adjustment applicants must use the Dates for Filing chart (USCIS filing charts page). Put simply, this month EB-2 visa numbers for India are authorized only for priority dates before November 1, 2013. A petition filed today gets a November 2026 priority date. That is a fact about the current queue, not a forecast; the bulletin can move forward, stall or retrogress.
How the EB-2 India date moved over the last year
Most guides quote one date. Movement over time tells you more. These figures come from the monthly bulletins in the State Department’s Visa Bulletin archive (“U” means unavailable: no visas could be issued in that column that month).
| Bulletin | EB-2 India Final Action Date | EB-2 India Date for Filing |
|---|---|---|
| December 2024 | 01AUG12 | 01JAN13 |
| October 2025 | 01APR13 | 01DEC13 |
| December 2025 | 15MAY13 | 01DEC13 |
| January 2026 | 15JUL13 | 01DEC13 |
| March 2026 | 15SEP13 | 01NOV14 |
| April and May 2026 | 15JUL14 | 15JAN15 |
| June 2026 | 01SEP13 | 15JAN15 |
| July to September 2026 | U | 15JAN15 |
| October and November 2026 | 01NOV13 | 15JAN15 |
Two lessons. First, the date can move backward: it reached 15JUL14 in spring 2026, fell back to 01SEP13 in June, and was unavailable at the end of the fiscal year. Second, over the 22 months from December 2024 to October 2026, the Final Action Date advanced about 15 months. The old version of this article quoted wait estimates of “50 to 100 years”. We removed them because no official source publishes such a figure.
Why the India line is so long
The bulletin itself explains the arithmetic. The worldwide employment-based level is at least 140,000 a year, and EB-2 receives 28.6% of it plus unused EB-1 numbers. Section 202 of the INA caps any single country at 7% of the combined family and employment preference limits; the October 2026 bulletin gives that figure as 25,620. When demand from one country exceeds its share, the prorating rules of section 202(e) apply. The bulletin lists China (mainland born), India, Mexico and the Philippines as the oversubscribed areas. Demand from India is far above its share, so India gets its own cut-off date.

Why Indians still file an EB2 NIW despite the backlog
An approved NIW I-140 has value long before a visa number is available. The table summarizes the main benefits and the rule behind each one.
| Benefit | What the rule says | Official source |
|---|---|---|
| H-1B beyond six years (approved I-140) | An H-1B worker with an approved EB-1, EB-2 or EB-3 petition who is held back only by the per-country limit may get H-1B extensions in increments of up to 3 years. The H-1B employer need not be the one that filed the immigrant petition, so a self-petitioned NIW qualifies. | 8 CFR 214.2(h)(13)(iii)(E) |
| H-1B beyond six years (I-140 pending) | If an immigrant petition was filed at least 365 days earlier, 1-year extensions are available while it remains pending, which helps if your I-140 is still undecided a year after filing. | 8 CFR 214.2(h)(13)(iii)(D) |
| Work permit for an H-4 spouse | An H-4 spouse may apply for employment authorization if the H-1B spouse is the beneficiary of an approved I-140 (or has H-1B time under AC21 sections 106(a) and (b)). | USCIS H-4 EAD page |
| A priority date you keep | An approved EB-1, EB-2 or EB-3 petition gives its priority date to any later petition in those categories, unless approval is revoked for fraud, willful misrepresentation or material error (or a labor certification problem). | 8 CFR 204.5(e) |
| Adjustment filing in Dates for Filing months | If you are in the U.S. and your priority date is earlier than the designated chart’s date, you may file Form I-485 and request a work permit and advance parole with it. | USCIS Form I-485 |
Premium processing is an option at the I-140 stage. It costs $2,965 for an EB-2 NIW, and USCIS must take action (approval, denial, RFE or NOID) within 45 business days, per its premium processing page. For Indian applicants it does not shorten the visa queue at all. It only gets you an I-140 decision sooner, which matters when an H-1B six-year limit or an H-4 spouse’s job depends on the approval. Our premium processing guide covers when it is worth paying. The base filing fees are $715 on paper or $665 online, plus the $300 Asylum Program Fee for self-petitioners (USCIS G-1055).
EB2 NIW India: details most guides skip
Your spouse’s country of birth can change your queue
Chargeability usually follows country of birth, not citizenship (USCIS). There is an exception many Indian families miss. The State Department’s Foreign Affairs Manual, 9 FAM 503.2-4(A), gives this example: an EB-2 beneficiary born in India whose accompanying spouse was born in France may be charged to France if the priority date is current for France but not for India. Both spouses must then immigrate together. If your spouse was born outside India, ask a licensed immigration attorney whether this alternate chargeability applies to you.
Children and age-out: the Final Action Date controls
Under the Child Status Protection Act, a derivative child’s age is calculated at the time a visa “becomes available”. USCIS says that date is the later of the petition approval date and the first day of the month in which the Final Action Dates chart shows a visa available (USCIS CSPA page). This catches Indian families out. A child can be included in an I-485 filed under the 15JAN15 Date for Filing, yet the CSPA age is fixed only when the much earlier Final Action Date passes the priority date. The time the I-140 was pending is subtracted, and the child must “seek to acquire” permanent residence within one year. See EB2 NIW for spouses and children.
A rejected or denied petition sets no priority date
Under 8 CFR 204.5(d), the NIW priority date is the date a completed, signed petition, including all initial evidence and the correct fee, is properly filed. Section 204.5(e)(3) adds that a denied petition does not establish a priority date. For an applicant facing a long India queue, a complete first filing is worth more than a fast one.
The EB-1 upgrade: what actually carries over
The earlier version of this article said an EB-2 NIW approval “can be ported” to EB-1. That was imprecise, and we have corrected it. You must file a new EB-1A or EB-1B petition and get it approved on its own evidence. What carries over is the priority date of the approved EB-2 petition, under 8 CFR 204.5(e)(1); if you have several approved petitions, you get the earliest date.
Hypothetical example: an India-born data scientist’s NIW I-140 was properly filed in February 2025 and approved. In 2027 she files and wins approval of an EB-1A petition. Her EB-1 case keeps the February 2025 priority date. In November 2026 the EB-1 India Final Action Date is 01FEB23, so she would still wait, but in a far shorter queue than EB-2 India. This is an illustration, not a client case, and EB-1 India can also retrogress. Software professionals should also read our EB2 NIW guide for software engineers.
Frequently Asked Questions
Can Indians apply for EB2 NIW without an employer?
Yes. The national interest waiver removes the job offer and labor certification requirement, so you can file Form I-140 as a self-petitioner. Nationality is not an eligibility factor.
What is the EB2 NIW India cut-off date in November 2026?
The EB-2 India Final Action Date is 01NOV13 and the Date for Filing is 15JAN15. USCIS designated the Dates for Filing chart for employment-based adjustment filings in November 2026.
Does premium processing shorten the India backlog?
No. It only speeds up USCIS action on the I-140 (45 business days for NIW). Your place in the queue is set by your priority date and country of chargeability.
Can an approved NIW extend my H-1B past six years?
Under 8 CFR 214.2(h)(13)(iii)(E), an approved EB-2 petition can support H-1B extensions in up to 3-year increments when the per-country limit is the only barrier. A new H-1B petition is still required each time.
Should I file both EB-1A and EB-2 NIW?
Some Indian professionals do, because the earliest approved priority date is retained. EB-1A has a much higher evidentiary bar. Assess honestly whether your record meets it before paying for a second petition.
