Last updated: November 2026. Each benefit below links to the statute, regulation or USCIS page it comes from. Fees and Visa Bulletin dates are as of November 2026.
The main benefits of EB2 NIW are that you need no job offer and no labor certification, you can file the petition yourself, and your spouse and unmarried children under 21 can get green cards with you. An NIW petition can also use premium processing. Once it is approved, it gives you a priority date you can keep for later EB-1, EB-2 or EB-3 petitions, and it can support H-1B time beyond six years. Each benefit comes from a specific rule, and each has a limit. This guide ties every benefit to its official source and ends with the limits that most benefit lists leave out. New to the category? Key takeaways
- The waiver comes from the statute. INA 203(b)(2)(B)(i) lets the government waive the job-offer requirement in the national interest, and the labor certification goes with it.
- You can be your own petitioner. The Form I-140 instructions let the beneficiary file an NIW petition.
- Premium processing for an NIW costs $2,965. USCIS promises to take action within 45 business days, and that action may be an approval, a denial, an RFE or a NOID.
- An approved NIW I-140 gives you a priority date that carries over to later EB-1, EB-2 or EB-3 petitions, unless USCIS revokes the approval for fraud or material error.
- The limits are real: Visa Bulletin waits (for November 2026 the EB-2 Final Action Date is 01NOV13 for India and 01OCT21 for China), a high evidence standard and no guaranteed result.
The 8 benefits of EB2 NIW at a glance
These national interest waiver benefits are not marketing claims. Each one is written into a law, a regulation or a USCIS page, and each comes with a condition.
| Benefit | Where it comes from | The limit |
|---|---|---|
| 1. No job offer or labor certification | INA 203(b)(2)(B)(i); Policy Manual Vol. 6, Part F, Ch. 5 | You must still qualify for EB-2 and meet all three prongs |
| 2. You file for yourself | Form I-140 instructions | You carry the whole burden of proof |
| 3. No employer tie when you file | Policy Manual Vol. 6, Part F, Ch. 5, Section D | You must still show how you will carry out the endeavor |
| 4. Premium processing | USCIS premium processing page; Form G-1055 | Guarantees action in 45 business days, not approval |
| 5. Spouse and children included | 8 U.S.C. 1153(d) | Children must be unmarried and under 21 |
| 6. Priority date carries over | 8 CFR 204.5(d) and (e) | Lost if approval is revoked for fraud or material error |
| 7. H-1B time past six years | 8 CFR 214.2(h)(13)(iii)(D) and (E) | Only for H-1B workers, through a separate H-1B petition |

Benefits of EB2 NIW, one by one, with the rule behind each
1. No job offer and no labor certification
Most EB-2 petitions need a U.S. employer and an approved PERM labor certification. The national interest waiver removes both. The statute, 8 U.S.C. 1153(b)(2)(B)(i) (INA 203(b)(2)(B)(i)), allows the government to “waive the requirements of subparagraph (A) that an alien’s services in the sciences, arts, professions, or business be sought by an employer in the United States.” The USCIS Policy Manual NIW chapter adds: “A waiver of a job offer also includes a waiver of the permanent labor certification requirement.”
The limit: the waiver is discretionary. You must first qualify for EB-2, through an advanced degree or exceptional ability, and then meet the three prongs of Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016).
2. You can file the petition yourself
For an NIW request, the Form I-140 instructions (edition 06/07/24) say that “any employer, individual, or third party may file this petition, including the petition’s beneficiary.” The USCIS EB-2 page puts it plainly: NIW applicants “may self-petition (you do not need an employer to sponsor you).” Under the G-1055 fee schedule (edition 10/26/26), Form I-140 costs $715 on paper or $665 online, plus a $300 Asylum Program Fee for self-petitioners. Our EB-2 NIW self-petition guide walks through the full package.
The limit: when you are the petitioner, the proof is yours to supply. The Policy Manual says “the burden rests with the petitioner to establish that the waiver of the job offer requirement is in the national interest.”
3. No employer tie at the I-140 stage
Because the job offer is waived, no single employer files or controls an NIW petition. The Policy Manual says that a petition with an NIW request “does not need to be supported by a job offer; therefore, the person may file as a self-petitioner.” Employees, researchers and founders can all file based on their own proposed endeavor.
The limit: the plan still has to be credible. A Policy Manual footnote says that for a petitioner who does not intend to be self-employed, “a job offer or communications with prospective employers, while not required,” are relevant to show “the circumstances or capacity in which the person intends to carry out the endeavor and the feasibility of that plan.” This guide does not cover changing jobs after filing. That depends on your status and the stage of your case, so ask a licensed immigration attorney.
4. Premium processing is available
The USCIS premium processing page lists “45 business days for Form I-140 E13 multinational executive and manager and Form I-140 E21 national interest waiver classifications.” The page says all pending and new E21 NIW petitions have been eligible since January 30, 2023. The fee in the current G-1055 is $2,965. Within the time frame, USCIS will “issue an approval notice, denial notice, notice of intent to deny, or a request for evidence; or open an investigation for fraud or misrepresentation.” Details are in EB2 NIW Premium Processing.
The limit: you pay for a fast decision, not a favorable one. If USCIS sends an RFE or NOID, the 45-day period “will stop and reset” once your response arrives.
5. Your spouse and children are included
Among the EB2 NIW green card benefits, family coverage is one of the most valuable. Under 8 U.S.C. 1153(d), a spouse or child is “entitled to the same status, and the same order of consideration” as the principal applicant “if accompanying or following to join.” The USCIS EB-2 page says that if your I-140 is approved, your “spouse and unmarried children under the age of 21 may be eligible” to immigrate too. They do not need petitions of their own. See EB2 NIW Spouse and Children.
The limit: a child must be unmarried and under 21. Age-out rules are complex, so a child near 21 is a question for a licensed immigration attorney.
6. You can keep your priority date
An NIW petition has no labor certification, so under 8 CFR 204.5(d) its priority date is “the date the completed, signed petition (including all initial evidence and the correct fee) is properly filed with USCIS.” After approval, 8 CFR 204.5(e)(1) says the petition “accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under section 203(b)(1), (2), or (3).” With several approved petitions, you are “entitled to the earliest priority date.” More in EB2 National Interest Waiver Priority Date.
The limit: under 204.5(e)(2), you lose the date if USCIS revokes the approval for fraud or willful misrepresentation, or because the approval “was based on a material error.” And “a denied petition will not establish a priority date.”
7. H-1B time beyond six years
For people already in H-1B status, an NIW I-140 can matter for the six-year limit. Two rules in 8 CFR 214.2 apply:
- 214.2(h)(13)(iii)(D): H-1B status beyond six years is possible if “at least 365 days have elapsed since” an immigrant visa petition was filed for you. Approvals come in increments of up to 1 year.
- 214.2(h)(13)(iii)(E): the beneficiary of an approved EB-1, EB-2 or EB-3 petition who is “eligible to be granted that immigrant status but for application of the per country limitation” can get increments of up to 3 years.
The limit: the extension is a separate H-1B petition filed by an H-1B employer, and it helps only people who hold or held H-1B status. Our EB2 NIW vs H1B comparison explains both rules. Status questions turn on your own facts, so speak with a licensed immigration attorney.
8. A path to permanent residence, then citizenship
After approval, you apply for the green card itself when a visa number is available. You can adjust status inside the United States or, from abroad, use consular processing. The USCIS consular processing page says: “If you are outside of the United States, you may apply at a U.S. Department of State consulate abroad for an immigrant visa.” Approved petitions for people abroad go to the State Department’s National Visa Center.
Later, the general naturalization rule requires that you “resided continuously in the United States after [your] lawful permanent resident (LPR) admission for at least 5 years” (Policy Manual Vol. 12, Part D, Ch. 3). You may file up to 90 days early, but you are “not eligible for naturalization until” the full five years are met (Vol. 12, Part D, Ch. 6). The limit: citizenship is never automatic. Physical presence and other requirements apply too.

What is the advantage of getting an I-140 approved?
Several I-140 NIW benefits switch on only at approval, not at filing:
- The priority date can be carried to a later EB-1, EB-2 or EB-3 petition (8 CFR 204.5(e)(1)).
- H-1B extensions in up to 3-year increments become possible when the per-country limit is the only barrier (214.2(h)(13)(iii)(E)).
- Your spouse and children can follow on your approved petition (8 U.S.C. 1153(d)).
- The case moves to the green card stage. USCIS describes the two routes that open “once you are the beneficiary of an approved immigrant petition and an immigrant visa number is immediately available to you.”
An approval is not a green card. You still wait for your priority date to be current, and the I-485 or immigrant visa is decided separately.
Limitations: what the benefits of EB2 NIW do not include
Visa Bulletin waits, especially for India and China
EB-2 visa numbers are capped by law. 8 U.S.C. 1153(b)(2)(A) sets the EB-2 share at “a number not to exceed 28.6 percent” of the employment-based worldwide level. So an approved petition can wait for years, and the wait depends on your country of chargeability. The November 2026 Visa Bulletin shows these EB-2 dates:
| Country of chargeability | Final Action Date | Date for Filing |
|---|---|---|
| All other countries (Rest of World) | 01APR25 | 15MAR26 |
| China (mainland born) | 01OCT21 | 01JAN23 |
| India | 01NOV13 | 15JAN15 |
For November 2026, USCIS says employment-based applicants “must use the Dates for Filing chart.” No NIW benefit shortens this queue. The dates change monthly, and we make no predictions.
A high evidence standard
Since the January 15, 2025 update, the Policy Manual makes EB-2 eligibility a threshold question: “If the person does not have the qualifications for the EB-2 classification, the petition is statutorily ineligible for the national interest waiver.” National importance must reach beyond your employer, because “benefits to a specific employer alone, even an employer with a national footprint, are not sufficiently relevant.” And “unsubstantiated claims would not meet the petitioner’s burden of proof.” Since August 5, 2026, under PA-2026-05, USCIS may deny a petition that lacks required initial evidence without sending an RFE first.
No guaranteed outcome
The Policy Manual says USCIS “may grant a national interest waiver as a matter of discretion.” The official numbers show both outcomes happen often. In April to June 2026, USCIS approved 3,835 NIW petitions and denied 3,103, and 96,297 were pending on June 30, 2026, according to its FY2026 Q3 Form I-140 data. These are national totals, not anyone’s individual odds.
Cost
A self-petitioner pays $715 on paper or $665 online, plus the $300 Asylum Program Fee, and $2,965 more for premium processing if they choose it (G-1055, edition 10/26/26). The green card stage has its own fees later, for Form I-485 or the immigrant visa.
Frequently Asked Questions
What are the main benefits of EB2 NIW?
The main EB2 NIW benefits are no job offer or labor certification, the right to file for yourself, green cards for your spouse and unmarried children under 21, premium processing, a priority date you can keep, possible H-1B time past six years, and a path to permanent residence and later citizenship.
Does premium processing mean my NIW will be approved faster?
It means USCIS will act within 45 business days, or refund the fee. The action can be an approval, a denial, an RFE or a NOID. It does not change what you must prove.
Can I get the benefits of EB2 NIW if I live outside the United States?
Yes. USCIS’s consular processing page explains how a beneficiary outside the United States applies for an immigrant visa at a U.S. consulate after the petition is approved and a visa number is available.
How soon after an NIW green card can I apply for citizenship?
Under the general rule, after 5 years of continuous residence as a permanent resident. You may file up to 90 days before that date, but you must meet the full period and the other naturalization requirements.
Are the benefits the same for applicants born in India or China?
The legal benefits are the same. The wait is not. In November 2026 the EB-2 Final Action Date is 01NOV13 for India and 01OCT21 for China, against 01APR25 for most other countries.
