EB2 NIW vs EB1A: Standards, Evidence, Premium Processing and Visa Bulletin Dates

EB2 NIW vs EB1A: Standards, Evidence, Premium Processing and Visa Bulletin Dates

Last updated: October 2026. Checked against 8 CFR 204.5, the USCIS Policy Manual (current as of October 23, 2026), Form I-140 and its instructions, the G-1055 fee schedule (edition 10/16/26) and the November 2026 Visa Bulletin.

EB2 NIW vs EB1A comes down to two different legal questions. EB-1A, extraordinary ability, asks whether you are “one of that small percentage who have risen to the very top of the field of endeavor.” You show this through sustained national or international acclaim: a one-time major award, or at least three of the ten criteria in 8 CFR 204.5(h)(3). The EB-2 national interest waiver (NIW) first asks whether you qualify for EB-2, through an advanced degree or exceptional ability. Then it asks whether your proposed endeavor, and your position to advance it, meet the three-prong Matter of Dhanasar test. With either one, you can file Form I-140 yourself, with no job offer and no labor certification. They use different Visa Bulletin queues, and 8 CFR 204.5(e) allows for more than one approved petition, so filing both is possible.

Below: a side-by-side table built from official sources, how each standard works, the profiles each rule is written for, premium processing and fees, November 2026 Visa Bulletin dates, and what the rules say about filing both. We don’t rank the two routes. The rules measure different things.

Key takeaways

  • You can file either one yourself. For EB-1A, “an alien, or any person on behalf of the alien” may file (8 CFR 204.5(h)(1)). For NIW, the USCIS EB-2 page says you “may self-petition.”
  • EB-1A looks at your standing and acclaim in the field. NIW looks at a specific proposed endeavor, after you clear EB-2 eligibility.
  • Premium processing costs $2,965 for both. USCIS commits to action within 15 business days for EB-1A (E11) and 45 business days for NIW (E21).
  • In the November 2026 Visa Bulletin, the EB-1 Final Action Date is “current” for Rest of World. EB-2 is April 1, 2025.
  • Form I-140 says “select only one box,” so filing both means two petitions and two sets of fees. Under 8 CFR 204.5(e), an approved petition’s priority date carries over, and you keep the earliest one.

The EB-1A standard: extraordinary ability under 8 CFR 204.5(h)

The petition must show “sustained national or international acclaim” and recognized achievements in your field. If you have no one-time achievement, you need at least three of these ten criteria, summarized from section 204.5(h)(3):

  • Lesser nationally or internationally recognized prizes or awards for excellence
  • Membership in associations that “require outstanding achievements of their members”
  • Published material about you in professional or major trade publications or other major media
  • Judging the work of others, individually or on a panel
  • Original contributions “of major significance in the field”
  • Authorship of scholarly articles
  • Display of your work at artistic exhibitions or showcases
  • A leading or critical role for organizations with a distinguished reputation
  • A high salary or other significantly high remuneration “in relation to others in the field”
  • Commercial success in the performing arts

The Policy Manual, Volume 6, Part F, Chapter 2 uses a two-step review. Step one checks which criteria the evidence meets. Step two is a final merits determination on whether the record as a whole shows you are among that small percentage at the very top. The chapter also says that “voluminous documentation may not contain sufficient persuasive evidence,” and that letters of support “should not form the cornerstone of a successful claim.” Sustained acclaim “does not imply an age limit.” A person “may be very young or early in his or her career.”

The EB-2 NIW standard: EB-2 eligibility plus Dhanasar

An NIW is a two-part test. In Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016), the AAO said a petitioner “must first” show that the person qualifies as an advanced degree professional or a person of exceptional ability, and must “then” show that waiving the job offer is in the national interest. Exceptional ability means “a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business” (8 CFR 204.5(k)(2)). The Policy Manual, Volume 6, Part F, Chapter 5 then applies three prongs:

  • The proposed endeavor has both substantial merit and national importance.
  • You are well positioned to advance it.
  • On balance, waiving the job offer and labor certification would benefit the United States.

The Policy Manual says “a person may be well-positioned to advance an endeavor even if the person cannot demonstrate that the proposed endeavor is more likely than not to ultimately succeed.” Under the January 15, 2025 update, the occupation behind an advanced-degree claim must be a profession. For an exceptional ability claim, the area of ability must be “directly related” to the endeavor. Our guide to the three prongs of EB-2 NIW covers each test in detail.

Extraordinary ability vs national interest waiver: who each rule is written for

Comparing EB1A vs EB2 NIW is mostly a question of which rule describes your record. “USCIS considers every petition on a case-by-case basis,” so the table describes the rules, not outcomes.

Read plainly, the EB-1A regulation is written for people whose record already shows sustained national or international acclaim. On its EB-1 page, USCIS gives “Pulitzer, Oscar, Olympic Medal” as examples of a one-time achievement. The NIW framework is written for advanced-degree professionals and people of exceptional ability with a defined endeavor of national importance. That includes endeavors whose success is uncertain: Dhanasar says “we do not, therefore, require petitioners to demonstrate that their endeavors are more likely than not to ultimately succeed.” Some records fit both, which is why the rules on filing both matter.

The USCIS premium processing page promises “adjudicative action,” which can be an approval, a denial, an RFE or a NOID. It does not promise an approval. An RFE or NOID stops the clock, and a new period starts when USCIS receives your response. For the full NIW budget, see how much EB-2 NIW costs. For timing details, see EB2 NIW premium processing.

EB-1 vs EB-2 NIW Visa Bulletin dates (November 2026)

The November 2026 Visa Bulletin gives first preference “28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.” Second preference gets 28.6%, “plus any numbers not required by first preference.” EB-1A shares the EB-1 queue with outstanding professors and multinational managers. NIW shares the EB-2 queue with PERM-based EB-2 cases.

Compared with the October 2026 bulletin, the EB-2 Final Action Date for Rest of World, Mexico and the Philippines moved from January 1, 2025 to April 1, 2025. EB-1 China moved from July 1, 2023 to August 1, 2023. For November 2026 adjustment filings, USCIS says to use the Dates for Filing chart for all employment-based categories (USCIS filing charts). These dates change monthly. See our EB-2 NIW priority date guide.

Can you file EB1A and NIW together?

Yes. Nothing in 8 CFR 204.5 limits you to one I-140, and section 204.5(e) refers to beneficiaries of “multiple approved petitions.” Part 2 of Form I-140 says “select only one box,” though, so each classification needs its own petition. Each petition carries its own filing fee and Asylum Program Fee. Premium processing works per petition too: USCIS says not to “submit multiple Forms I-907 for the same Form I-140.” Here is what the rules say about running both:

  • Priority date retention. Under 204.5(e)(1), an approved EB-1, EB-2 or EB-3 petition gives you its priority date “for any subsequently filed petition” in those categories. With multiple approved petitions, you are “entitled to the earliest priority date.”
  • Exceptions. You cannot retain the date if approval is revoked for fraud or willful misrepresentation, for a material error, or because the labor certification was revoked or invalidated. “A denied petition will not establish a priority date.”
  • One basis for each green card application. The Policy Manual, Volume 7, Part A, Chapter 8 says “only one petition may form the basis of an adjustment application at any given time.” A transfer to another basis must be requested in writing, and a visa must be available in the new category on the date of the request.
  • Transfers are discretionary. The same chapter says that, “except for simple transfers between the first three employment-based categories,” applicants should not assume a transfer will be granted automatically.

Frequently Asked Questions

Is one standard higher than the other?

The Policy Manual calls exceptional ability a lower standard than extraordinary ability. But an NIW adds a separate waiver test, the Dhanasar prongs, which EB-1A does not have. Which one fits depends on what your record shows.

Can I file EB-1A and NIW at the same time?

Yes, as two separate I-140s, each with its own fees. Under 8 CFR 204.5(e), you keep the earliest priority date among your approved petitions.

Does EB-1A require a degree?

Section 204.5(h) sets no degree requirement. An NIW requires EB-2 eligibility first, through an advanced degree or exceptional ability.

Which has faster premium processing?

EB-1A: action within 15 business days. NIW: within 45. Both cost $2,965, and “action” can mean an RFE rather than a decision.

If my NIW is approved, can a later EB-1A use its priority date?

Generally yes. Section 204.5(e)(1) carries an approved EB-2 petition’s date over to a later EB-1 petition, unless one of the revocation exceptions applies.
