EB2 NIW I-140 Approved: Your Next Steps to a Green Card (2026)

EB2 NIW I-140 Approved: Your Next Steps to a Green Card (2026)

Last updated: October 2026. Checked against the USCIS Policy Manual, the Form I-485 instructions (09/18/26 edition), the G-1055 fee schedule (10/16/26 edition) and the October 2026 Visa Bulletin.

Once your EB2 NIW I-140 approved notice arrives, USCIS has classified you as an EB-2 immigrant and waived the job offer. It is not a green card yet. Two things decide what happens next. The first is whether your priority date is current on the Visa Bulletin chart USCIS designates for that month. The second is where you are. If you are in the United States and eligible to adjust status, you file Form I-485 with USCIS. If you are abroad, or prefer to apply abroad, USCIS sends your case to the State Department’s National Visa Center (NVC) for an immigrant visa.

This guide covers the approval notice, your priority date, both routes, October 2026 fees, the I-693 rule, interviews and timing. One detail many guides miss: you may be allowed to file under one Visa Bulletin chart but can only be approved under the other. Each step is decided separately.

Key takeaways

  • An approved I-140 lets you apply for permanent residence once a visa number is available. On its own, it does not make you a permanent resident.
  • Your priority date is the date USCIS properly received your complete I-140, and it is printed on your I-797 notice.
  • For October 2026, USCIS requires employment-based adjustment applicants to use the Dates for Filing chart (EB-2 Rest of World: 15MAR26). Final approval still needs a current Final Action Date (EB-2 Rest of World: 01JAN25).
  • A post-approval I-485 must include Form I-693 in the same package and a signed statement that you intend to work in the field named in your I-140. NIW applicants do not file Supplement J.
  • For consular processing, the employment-based immigrant visa fee is $345 per person, and the USCIS Immigrant Fee is $235.
  • Answer NVC on time. Under INA 203(g), failing to apply within one year of notice of visa availability puts the petition, and your priority date, at risk.

What your EB2 NIW I-140 approved notice (Form I-797) means

USCIS sends its decisions on Form I-797. In its list of I-797 notice types, the I-797 Notice of Action “communicate[s] receipt or approval” of a petition, and the I-797B is “issued for approval of an alien worker petition.” Either way, it is a notice from USCIS. It is not a form you fill out, and it is not a travel or status document.

Check three things on it right away:

  • Receipt number. Later forms ask for it. Form I-824, for example, is rejected if the I-797 receipt number is missing.
  • Priority date. The Policy Manual (Volume 7, Part A, Chapter 6) says your priority date appears on the I-797. An NIW petition has no labor certification, so under 8 CFR 204.5(d) the priority date is the date the completed, signed petition, with all initial evidence and the correct fee, was properly filed.
  • Your personal details. Check your name and date of birth against your passport. Your visa is charged to a country, usually your country of birth, and that country decides which Visa Bulletin column applies to you.

Keep the original notice safe. If you lose it, Form I-824 can be used to request a duplicate approval notice. The fee is $590.

Check your priority date against the Visa Bulletin

Each month the Visa Bulletin publishes two charts. Final Action Dates show when a visa can be issued or a green card approved. Dates for Filing show when you can start the paperwork. USCIS’s Adjustment of Status Filing Charts page says which chart applicants in the United States must use for filing that month. For October 2026, it says all employment-based categories must use the Dates for Filing chart.

EB-2, October 2026Final Action DateDate for Filing
All chargeability areas (Rest of World)01JAN2515MAR26
China (mainland born)01OCT2101JAN23
India01NOV1315JAN15
Mexico01JAN2515MAR26
Philippines01JAN2515MAR26

Your priority date must be earlier than the date listed for your country. Nigeria, Kenya, Pakistan and Colombia have no separate column, so applicants born there use the “All chargeability areas” column.

The two-chart catch

The Policy Manual says a visa must be available both when you file Form I-485 and when USCIS approves it. The bulletin in effect when you file decides whether you were allowed to file. For the approval itself, USCIS uses the Final Action Dates chart in effect at that time. Hypothetical example: a Rest of World applicant with a June 1, 2025 priority date can file in October 2026 under the Dates for Filing chart (15MAR26). USCIS cannot approve the green card, though, until the Final Action Date passes June 1, 2025. Filing early can still help, because Forms I-765 and I-131 can be filed together with the I-485.

Dates can also move backward. The October 2026 bulletin notes that some Rest of World employment-based categories retrogressed at the start of fiscal year 2027. Check both the bulletin and the USCIS chart page every month.

EB2 NIW I-140 approved: choosing between the two routes

According to USCIS’s consular processing page, once you have an approved petition and a visa number is immediately available, you can apply in one of two ways: adjustment of status inside the United States, or an immigrant visa at a U.S. consulate abroad.

Final stepUSCIS approves the I-485Visa issued; admitted as a permanent resident at the port of entry

Route 1: Adjustment of status with Form I-485

Under the Policy Manual, someone adjusting under INA 245(a) must have been inspected and admitted or paroled, and must not be subject to the INA 245(c) bars. Those bars cover, among others, people who violated status, failed to maintain status or worked without authorization. Some employment-based applicants can overcome certain bars under INA 245(k). These questions turn on your exact facts. If you have any gap in status, talk to a licensed immigration attorney before you file.

According to the Form I-485 page and the I-485 instructions, a principal NIW applicant who files after the I-140 is approved needs:

  • The current form edition. Since September 18, 2026, USCIS accepts only the 09/18/26 edition, which was revised for the Public Charge final rule. It rejects older editions.
  • A photocopy of the I-797 for the underlying petition.
  • Form I-693 in the same package (see below).
  • A signed statement of intent. Self-petitioners “must intend to work in the occupational field specified in the Form I-140.” A signed statement confirming this is required unless the I-485 is filed together with the I-140 or while the I-140 is still pending.
  • No Supplement J. The instructions say NIW applicants do not need it, because the category is not tied to a specific job offer.
  • Optional work and travel permits: Form I-765 and Form I-131 (advance parole), each with its own fee.

Your spouse and children each file their own I-485. They can include a photocopy of your approval notice. If they are abroad while you adjust, Form I-824 lets you ask USCIS to notify a consulate through the NVC once your I-485 is approved, so they can apply to follow to join you.

Route 2: Consular processing through the NVC

  1. USCIS sends the approved petition to the NVC if you live abroad or want to apply abroad.
  2. The NVC creates your case and sends a Welcome Letter. You then manage the case in CEAC.
  3. You pay the immigrant visa application fee ($345 for employment-based cases). The NVC says to allow 10 calendar days for it to process payments before the DS-260 opens.
  4. You complete the DS-260 and upload civil documents. The NVC reviews the file, and the embassy schedules an interview depending on its appointment availability.
  5. You complete the medical exam with an embassy-approved panel physician. Exams by other doctors are not accepted.
  6. If the visa is issued, you pay the USCIS Immigrant Fee and travel. USCIS mails your green card after you are admitted and the fee is paid.

Do not ignore NVC letters. The NVC page quotes INA 203(g): the State Department “shall terminate the registration” of anyone who fails to apply within one year of notice of visa availability. The petition can be reinstated only if, within two years, you show the failure was for reasons beyond your control.

The I-693 medical exam must go in with your I-485

The I-693 page says that since December 2, 2024, you must submit Form I-693 (or a partial I-693, where that applies) together with your I-485. Otherwise, USCIS may reject the I-485. Key points:

  • A civil surgeon performs the exam and gives you the signed form in a sealed envelope. Do not accept it unsealed. You, not the surgeon, submit it to USCIS.
  • Paper filing: send the envelope sealed, in the same package as the I-485.
  • Online filing: open the envelope, upload the completed form, and keep the original and the envelope until USCIS decides your case. USCIS may ask to see them at an interview.
  • If a package is rejected and comes back with the envelope opened, you may refile using the opened original together with a copy of the rejection notice.
  • Validity rules are in the Policy Manual, Volume 8, Part B, Chapter 4. Read them before you book the exam.

Will you have an interview?

For adjustment, the Policy Manual (Volume 7, Part A, Chapter 5) states: “All adjustment of status applicants must be interviewed by an officer unless the interview is waived by USCIS.” Waivers are decided case by case. USCIS does not have to waive an interview even in the listed waiver categories, and derivatives must also appear. Consular applicants are interviewed at the embassy or consulate. For more on what to expect, see does EB-2 NIW require an interview.

What affects the time from NIW approval to green card

There is no fixed timeline, and nobody can promise one. These are the factors that matter:

  • Priority date and country of chargeability. This is the biggest factor by far for India and China.
  • How the bulletin moves. Dates can advance, stall or retrogress.
  • USCIS office workload. Check the official USCIS processing times tool for your form and office.
  • Completeness. Under the August 5, 2026 Policy Alert (PA-2026-05), USCIS may deny a request without an RFE when required initial evidence is missing, so file a complete package. Our EB-2 NIW document checklist can help.
  • Interview and appointment availability at your USCIS field office or embassy.
  • Nationality-based policies. As of October 2026, a USCIS alert dated August 28, 2026 says an August 24, 2026 court order blocked the USCIS adjudication-hold memos that affected nationals of the 39 countries listed in Presidential Proclamations 10949 and 10998. If this affects you, check the alert and get attorney advice.

Frequently Asked Questions

Is an approved EB-2 NIW I-140 the same as a green card?

No. The approval establishes your immigrant classification. You still need a visa number and an approved I-485 or immigrant visa before you become a permanent resident.

Can I file Form I-485 the day my NIW is approved?

Only if your priority date is earlier than the date on the chart USCIS designates for that month. For October 2026 that is the Dates for Filing chart (EB-2 Rest of World 15MAR26, India 15JAN15, China 01JAN23).

Do I need a job offer or Supplement J at the I-485 stage?

No. The I-485 and Supplement J instructions say NIW applicants do not file Supplement J. Self-petitioners who file after approval do need a signed statement that they intend to work in the occupational field named in the I-140.

What happens if I ignore letters from the NVC?

Under INA 203(g), the registration can be terminated if you do not apply within one year of notice of visa availability. You would then lose the benefits of the petition, including your priority date.

How long does it take from NIW approval to a green card?

It depends on your priority date, country of birth, bulletin movement and USCIS or embassy workload. Check the Visa Bulletin and the USCIS processing times tool rather than averages.
