EB2 NIW From Ghana: Eligibility, Accra Processing and 2026 Visa Pause Status

EB2 NIW From Ghana: Eligibility, Accra Processing and 2026 Visa Pause Status

Last updated: October 2026. Each policy statement below is dated and linked to the official page it comes from. Travel measures, visa pauses and court orders change quickly, so recheck the linked pages before you act.

Yes, Ghanaian professionals can apply for an EB2 NIW. As of October 21, 2026, Ghana is not named in Presidential Proclamation 10998. Ghana was on the State Department’s January 2026 list of 75 countries whose immigrant visas were paused, but the Department says that pause has been lifted since August 21, 2026 under a court order. For EB2 NIW Ghana applicants the path is the same as everywhere else: meet the EB-2 and Dhanasar standards, file Form I-140 with USCIS, and wait in the Rest of World Visa Bulletin queue. Applicants living in Ghana then interview at the U.S. Embassy in Accra, which now adds a document prescreening step.

Key takeaways

  • Nationality does not affect NIW eligibility. Ghanaian petitioners face the same legal test as anyone else.
  • Ghana is not on either Proclamation 10998 list. It was on the 75-country immigrant visa pause list, and the State Department says that pause stopped applying on August 21, 2026.
  • Ghana is charged to Rest of World. In the October 2026 Visa Bulletin, the EB-2 Final Action Date for that chart is 01JAN25 and the Date for Filing is 15MAR26.
  • Accra prescreens every immigrant visa applicant’s documents, and you may be interviewed the same day if nothing is missing.
  • Ghanaian civil documents have special rules. Late-registered birth certificates need secondary evidence, and married applicants must submit a civil marriage certificate.

EB2 NIW Ghana: policy status as of October 2026

We checked each measure against official pages on October 21, 2026. The table repeats only what those pages say.

MeasureWhat the official source says (as of October 21, 2026)Official source
Proclamation 10998 (signed December 16, 2025; effective January 1, 2026)Covers 39 countries plus Palestinian Authority documents. Ghana is not on either list. Neighbouring Burkina Faso is fully suspended, and Togo and Côte d’Ivoire are partially suspended.White House; State Department
Immigrant visa pause for 75 countries (from January 21, 2026)Ghana was on the list. Applicants could still interview, but no visas were issued. The State Department says that, as of August 21, 2026, the pause is no longer in effect under the court’s order in CLINIC et al. v. Rubio, et al.State Department
USCIS adjudication hold policies (PM-602-0192 and PM-602-0194)Tied to the 39 countries in Proclamations 10949 and 10998, and Ghana is in neither. A Rhode Island court vacated them on June 5, 2026, and a California court enjoined them on August 24, 2026.USCIS (June 2026); USCIS (August 2026)
Realignment of visa services in Africa (from August 1, 2026)Accra is a regional visa hub and keeps routine immigrant visa services. The notice (last updated July 15, 2026, before the pause ended) said that nationality-based pauses “remain in place”.State Department
Interview location rule (from November 1, 2025)NVC schedules interviews in your country of residence or, on request, nationality.State Department

Two cautions. First, the pause ended because of a court order, and the official pages do not say whether further litigation could change that. Check the State Department page again before your interview. Second, these measures follow nationality. If you hold a listed nationality or dual nationality, different rules may apply, so speak with a licensed immigration attorney.

Who qualifies for EB2 NIW from Ghana

Under the January 15, 2025 USCIS guidance update, officers check EB-2 eligibility first and only then weigh the waiver.

Layer 1: EB-2 eligibility and a Ghanaian degree

Under the USCIS Policy Manual, an advanced degree means a U.S. degree above the bachelor’s level or a foreign equivalent degree. A bachelor’s plus five years of progressive, post-degree experience also qualifies. The alternative is exceptional ability: at least three of the six criteria in 8 CFR 204.5(k)(3)(ii), which include a professional licence and membership in professional associations.

A Ghanaian degree must be accepted as the foreign equivalent of the U.S. degree you rely on, so most petitioners include a credential evaluation. The Policy Manual calls credential evaluations “solely advisory”: the officer decides. File the evaluation with your transcripts, the “official academic record” required by the USCIS EB-2 page. If you use the bachelor’s-plus-five-years route, read our guide to documenting post-degree experience.

Layer 2: the three Dhanasar prongs

Matter of Dhanasar, 26 I&N Dec. 884 (AAO 2016) requires an endeavor of substantial merit and national importance, that you are well positioned to advance it, and that a waiver benefits the United States on balance. Ghanaian work, such as power-sector or public health projects, can support prong 2. Prong 1 concerns your future work in the United States.

Hypothetical example: a Ghanaian electrical engineer with a BSc and six years of post-degree grid experience proposes to work on distribution-network reliability for U.S. utilities. The petition proves degree equivalency and experience and links past results to the U.S. plan. This is an illustration, not a client case. Our page on EB2 NIW for engineers covers how engineering endeavors are framed, and the three prongs guide walks through each test.

Step 1: file Form I-140 with USCIS

According to the USCIS EB-2 page, an NIW petition must include Form ETA-9089 Appendix A and a signed Final Determination. A USCIS policy update of August 5, 2026 lets officers deny without first issuing an RFE when required initial evidence is missing, so file a complete petition. Your priority date is the date USCIS accepts the I-140.

A self-petitioner pays $965 in USCIS fees online ($1,015 on paper), before any premium processing. Our EB2 NIW cost guide breaks down every stage.

Step 2: the Visa Bulletin chart for Ghana

The Visa Bulletin has separate EB-2 columns only for China (mainland born), India, Mexico and the Philippines. Ghana has no column of its own, so Ghanaian applicants fall under “All Chargeability Areas Except Those Listed”, usually called Rest of World. USCIS explains that your country of chargeability is usually your country of birth, not your citizenship. A Ghanaian citizen born in India, for example, may be charged to India.

EB-2, Rest of World (includes Ghana)October 2026 Visa BulletinWhat it means
Final Action Date01JAN25A visa can be issued only if your priority date is earlier than this date.
Date for Filing15MAR26If your priority date is earlier than this, you may submit documents to NVC once NVC invites you to.

Sources: the October 2026 Visa Bulletin (on October 21 the State Department listed the November bulletin as “coming soon”) and the USCIS adjustment filing charts page. A petition filed today will have a priority date later than both dates. Our priority date guide explains how to track the queue.

Step 3: EB2 NIW Ghana consular processing at the U.S. Embassy Accra

After USCIS approves the I-140, your case moves to the National Visa Center. There you pay the $345 fee, complete the DS-260 and upload your civil documents. Once your priority date is current, NVC schedules the interview in Accra. Embassy Accra says most immigrant visa cases are electronic, so documents are uploaded through CEAC and not mailed.

Accra’s prescreening appointment

Most guides miss this. Embassy Accra is rolling out prescreening for every immigrant visa applicant. If NVC schedules your interview, prescreening happens at that appointment, and if your documents are complete you may be interviewed the same day; if anything is missing, the interview is moved to a later date. Some applicants are invited by IVAccra@state.gov instead. The embassy says prescreening does not shorten interview waits but can reduce post-interview processing. Check your spam folder.

Ghanaian civil documents (State Department schedule)

The State Department’s Ghana civil documents page has several Ghana-specific rules that applicants often miss:

DocumentIssuing authority and what to know
Birth certificateIssued by the Registrar of Births and Deaths. It is free if the birth was registered within 12 months; after that the fee is GHC 20. The page says registrations made more than a year after birth are not reliable evidence on their own, so secondary evidence is required. Examples include a midwife’s certificate, a weighing card or a baptismal certificate. WAEC/WASSCE records show the date of birth and can be verified by the embassy.
Marriage certificateCivil and customary marriages are registered with the Registrar General’s Office; Islamic marriages with the Registrar of Mohammedan Marriages. “For immigrant visa purposes, applicants must submit their civil marriage certificate.” A customary marriage is shown on the civil certificate as “married under customary law”.
DivorceA decree from the High Court, Circuit Court or District Court. For a customary divorce, a sworn statutory declaration on its own is not proper documentation.
Police certificateA “Criminal Check” from the Criminal Investigation Department (CID) of the Ghana Police Service. Certified copies are not available.
Passport and Ghana CardPassports are issued by the Ministry of Foreign Affairs and Regional Integration; the Ghana Card by the National Identification Authority.
Court, prison and military recordsFrom the court concerned, the Director General of Prisons, or the Ministry of Defence, if they apply to you.

Getting a Ghana police certificate from inside or outside Ghana

Residents apply at CID headquarters in Accra, where fingerprints are taken. Applicants abroad send the request by courier to the Commissioner of Police, CID Headquarters, with the $200 transfer receipt, passport bio page, two photos and the details the page lists. NVC’s civil documents step requires anyone aged 16 or older to get a police certificate from their country of nationality (if they lived there more than six months), from any country where they lived 12 months or more after turning 16, and from any place they were arrested. Certificates generally expire after two years, and Accra wants a newer one if yours went to NVC over a year ago and you still live in Ghana.

Medical exam with an Accra panel physician

  • The Accra instructions (last updated August 14, 2023) list two approved clinics: Akai House Clinic in Cantonments and Holy Trinity Medical Centre in North Kaneshie. Results from other physicians are not accepted.
  • Have the exam at least three weeks before your interview. If you do not, your case will be delayed.
  • Bring your interview letter, passport, three 5 cm x 5 cm colour photos, immunization records and the DS-260 confirmation page. Pay all fees directly to the clinic.
  • The clinic sends the report to the embassy. Carry any X-rays on your first trip; the report must be under six months old when you enter.

Interview day in Accra

Bring the NVC letter, a passport valid six months beyond entry plus a bio-page copy, two 5 cm x 5 cm photos, the DS-260 confirmation, and original civil documents with photocopies. Unpaid fees are cash only, in dollars or cedis. Phones, laptops and smart watches are banned, with no storage, and attorneys may not attend. The checklist asks employment-based applicants for a U.S. employer letter dated within one month; it does not address NIW self-petitioners without an employer, so ask the embassy in advance. If approved, the embassy keeps your passport to print the visa. Per its collection notice, Accra pickup moved to the OIS office in Labone on September 15, 2025, with paid DHL pickup in Tema, Kumasi, Tamale and Takoradi.

Then pay the $235 USCIS Immigrant Fee online; no green card is issued until it is paid. The embassy stresses there is “no guarantee that you will receive a visa”, so do not sell property, resign or book non-refundable travel before the visa is in your passport.

If you are already in the United States

Ghanaians in the U.S. in lawful status may be able to file Form I-485 instead of going through Accra, once their priority date is earlier than the date on the chart USCIS designates for that month. The fee is $1,440 on paper or $1,390 online for applicants aged 14 or older (G-1055). Whether you can adjust status depends on your immigration history, so ask a licensed immigration attorney.

Common mistakes in EB2 NIW Ghana cases

  • Relying on January 2026 news that still describes Ghana as paused. Read the current State Department page.
  • Submitting a late-registered birth certificate on its own. Add the secondary evidence the State Department page describes.
  • Submitting only a customary marriage record. Accra requires the civil marriage certificate, which may mean registering your customary marriage first.
  • Describing a Ghana-only endeavor. Your record in Ghana supports prong 2; prong 1 must describe U.S. work of national importance.
